Dear Mr. Gambert,

It appears that you have filed an legal action in Arizona.  It is likely that it is being handled by the “Civil section” of the US Attorney’s office in Arizona.  That office maintains the records of the attorney handling your case, which is the information you appear to be seeking.

I would suggest that you direct a FOIA request to that office.  As I advised you in my response to your FOIA request, which was referred to my office, the Civil Division Headquarters in Washington, does not have the records you are seeking.

Hi Jim,

Please let me first take the opportunity to thank you for your invaluable service. Let me back up, the USPTO in Virginia is withholding my property against the law, the administrative judges with the interlocutory attorney are all aware of the allowing of a late filing to move forward against Federal Statute, Internal Agency Law, and the Constitution.

With that said, they are covering it all up, they won’t do what is right, and after I am through getting the information I need with your invaluable help, I will be holding everyone accountable over there. It is imperative that I get this single information, but first please allow me to bring it up to where we are at now.

After countless attempts of trying the Agency and there “Agents” to do what the law requires them to do, with no avail, I am now have been forced to file a Notice of Complaint and Claim, to the Department of Justice, and the USPTO at the same time according to FTCA Regulations.

With my Checking in to Washington, the delightful lady had found my record of submission, she had informed me that they sent it over to Arizona, to be handled by yes the “Civil” division.

Now when I called over there I spoke to another lady, one that does not return my phone calls, and the internet opt in to another Agent, they give no response to who is processing this claim.

Therefore I have been forced to file an FOIA to find out who and what Agent if any is processing this claim, not only for myself, but for the News.

My search of the Civil Division’s automated CASES database, which contains information on cases and matters handled by the Civil Division, failed to identify any references to an FTCA case in your name.  Therefore, the Civil Division has no records responsive to your request.  If you have any questions regarding the processing of your request in my office, you may contact me at 202 514-3319.

If you are dissatisfied with my action on your request, you have a right to appeal to the Director, Office of Information Policy (OIP), United States Department of Justice, 1425 New York Avenue, NW, Suite 11050, Washington, DC  20530-0001.  See 28 CFR § 16.9 (2010).  Please note that your appeal must be received by OIP within sixty calendar days of the date of this letter or it will be untimely.
